Terms & Conditions

The following General Terms and Conditions apply exclusively to the ordering and sending of goods which the customer [private end consumer] orders on the Internet via online shopping. With an order these AGB are recognized.

1. Conclusion of contract

The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog. After entering your personal data and by clicking the button "Buy" in the final step of the ordering process, you place a binding order to purchase the goods in the shopping cart. The confirmation of the receipt of the order follows immediately after sending the order. The purchase contract is concluded with our order confirmation or delivery of the goods. An order is alternatively also possible by telephone under 02421-2773216.

2. Contract text

Your order data are stored by us and are for you in your customer login area also afterwards for you visible if a customer account with password was created. You will also receive a summary of your order data by email. If you do not receive this email, due to possibly wrong entries, please contact the Service: info@smartstylez.de

3. Revocation

Right of withdrawal

You have the right to revoke this contract within fourteen days without giving reasons. The withdrawal period shall be fourteen days from the date on which you or a third party other than the carrier designated by you have taken or have taken possession of the last goods. To exercise your right of cancellation you must inform us SmartStylez, Am Hahn 3, D-52399 Merzenich, Tel.: 02421-2773216, E-Mail: info@smartstylez.de by means of a clear statement (e.g. a letter or e-mail sent by post) of your decision to cancel this contract. You can use the attached sample withdrawal form for this purpose, which is, however, not mandatory. You can download a revocation form (a pdf) here*as well. You may also electronically complete and submit the sample withdrawal form or other unambiguous statement on our web site https://www.smartstylez.de/en/return. If you make use of this option, we will immediately (e.g. by e-mail) send you a confirmation of receipt of such a revocation. In order to comply with the revocation period, it is sufficient for you to send notice of the exercise of the right of revocation before the expiry of the revocation period.

Consequences of revocation

If you revoke this Agreement, we will refund to you all payments we have received from you, excluding delivery charges, immediately and no later than fourteen days from the date we receive notice of your revocation of this Agreement. For this refund we will use the same means of payment as you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged for this refund. We may refuse to refund until we have received the Goods (including premium items) back or until you have proved that you have returned the Goods, whichever is earlier. You must return or hand over the goods to us immediately and in any case within fourteen days of the day on which you notify us of the revocation of this contract at the latest. This period shall be deemed to have been observed if you dispatch the goods before expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You shall only be liable for any loss in value of the goods if such loss in value is attributable to handling of the goods that is not necessary to inspect their condition, properties and functionality.

4. 14 Days exchange right & low price guarantee

SmartStylez provides the customer with a voluntary 30-day exchange opportunity from the date of delivery, whereby in addition to the direct exchange of goods it is also possible to issue a goods voucher. Excluded from the exchange are goods that have already been used or goods, including all accessories such as packaging and documentation, that are no longer in their new condition. If the buyer finds the same product at another authorized dealer within 30 days of placing the order at a lower price (including all ancillary costs such as postage and packing as well as sponsored voucher promotions), and if this product is available from the dealer's warehouse, the customer is entitled to a refund of the difference.

5. Delivery and returns

The delivery is either ordered by SmartStylez itself, or in exceptional cases via a supplier. SmartStylez is anxious to deliver the ordered goods to the customer as soon as possible. If the customer does not accept the product despite a period set to him or if he refuses the acceptance, SmartStylez can withdraw from the contract after its choice. The respectively valid forwarding expenses take you please from the menu point forwarding expenses under information. As a consumer you are asked to check the goods immediately upon delivery for completeness, obvious defects and transport damage and to notify the seller and the carrier of any complaints as soon as possible. Your warranty claims remain unaffected by this. If possible, please use the original packaging or packaging that corresponds to our shipping packaging with the protective devices for possible returns in order to avoid damage to the goods.

6. Offsetting

The customer can set off only with such demands, which are legally determined or by SmartStylez not denied. A right of retention is entitled to the customer only because of claims from the same contractual relationship.

7. Delay

If the customer is in arrears with his payments, interest of 3% above the base interest rate of the European Central Bank will be charged on the outstanding amounts. The customer reserves the right to prove that SmartStylez has suffered little or no damage. SmartStylez expressly reserves the right to assert further claims.

8. Payment

The purchase price is due immediately after receipt of our order confirmation. The customer can pay the purchase price by bank transfer to the account specified in the order confirmation, by Paypal, credit card or purchase on invoice. The total price stated in the order confirmation is to be paid. All prices already include the German value added tax of currently 16%, which is shown separately on the invoice. Until the complete payment the commodity remains property of SmartStylez. Further details to the methods of payment take you from the menu point Payment / Dispatch.

9. Warranty and customer service

SmartStylez guarantees the proper functioning of all products sold according to the manufacturer's specifications. The prerequisite for claiming the guarantee is the careful handling of the product such as the intended use of the product in accordance with the use and care instructions. Nevertheless, it comes due to possible errors in the production of the goods to inconvenience and a replacement is not possible, SmartStylez can either exchange into a comparable product of the same brand or quality, or refund the purchase price. With all goods from our Shop legal warranty rights exist. Please refer to the product documentation for information on individual manufacturer warranties.

10. Place of performance, place of jurisdiction

For all present and future claims arising from the business relationship, including bills of exchange and cheques, the exclusive place of jurisdiction for merchants is the registered office of the seller. Place of jurisdiction and place of performance for merchants is Merzenich.

11. Final Provisions, Severability Clause

Should one or more provisions of these GTC be ineffective, this shall not invalidate the entire contract. The ineffective regulation is replaced by the valid legal regulation. To this contract exclusively German right is applicable.
